Letter of James Madison [manuscript] : Montpelier, to Judge Spencer Roane, Hanover Town, 1821 May 6. 1821.

Madison responds to a letter soliciting opinions on recent Supreme Court decisions, especially where they affect the reserved rights of the states; with comment that judicial power is less formidable to those rights than are the encroachments of Congress, but adding his opinion that both together cannot succeed in durable violations of those rights. The Supreme Court cases discussed include the exclusive jurisdiction of Congress over "the ten miles square" [i.e. District of Columbia] and other specified places, and involuntary submissions of the states to the Court.
